TUN MOHD EUSOFF CHIN – SATU LAGI SALAH LAKUNYA DIBONGKAR

Mengikut Kod Etika Kehakiman Perkara 125 (3A) yang berkuat kuasa pada 22 Disember 1994, antara lain menyebut ia melarang hakim daripada membuat satu perkara yang boleh menjejaskan keunggulan mahkamah seperti berjual beli, menerima hadiah daripada mana-mana pihak yang berkaitan dengan kes atau menerima jemputan ke jamuan mereka.

 

 

 

CELEBRATION DINNER FOR EUSOFF CHIN

 

 

The sensitive information relates to a dinner function, held to celebrate the appointment of the Chief Justice to ‘Dato’ status in July 1997, in itself this is not an unusual occurrence in Malaysia, nor anywhere else for that matter.

 

This particular function was a ‘Celebration Dinner for Yaa Tun Dato’ Sri Mohd Eusoff bin Chin’ held at the HYATT REGENCY HOTEL, Saujana, Kuala Lumpur, Malaysia, on 9 th July 1997. Photographs at Appendix ‘A’ show function details.

 

The Hotel documents show that the host for the function was Justice H.B LOW and shows the name of his secretary and LOW’s business address – Appendix ‘B’. The total bill for this function was 3,803.16 Malaysian Ringgit (MR).

 

Copy receipts from the Hotel Banquet/Convention No’s : 005451 and 005450 show that an International Buffet Dinner was provided at 48 MR per person for 60 people at a cost 2,880.00 MR. The name of the host is shown as Dato’ Justice LOW. The drinks bill for the function is recorded as 53 Guava Juice, 39 Orange Juice,2 S/Fruit Juice, settled at 02.16 a.m for 918.85 MR – Appendix ‘C’.

 

Both these bills were signed by J. SHAIK, paying by American Express Card No : 37623020024018 in the name of Judith SHAIK.

 

A room service bill No : 173435, Appendix ‘D’, shows that a packet of Salem King Size cigarettes was supplied at 9.55 p.m. in relation to Justice LOW’s function and paid for at 02.17 a.m. by Judith SHAIK using her Amex Card. The copy of Amex receipt is shown for the full amount of 3,803.16 MR at Appendix ‘D’.

This celebration dinner was attended by businessmen, their wives and members of the Judiciary, including CHIN, Justice H.B. LOW and V.K. LINGHAM; they did not pay for it.

 

Judith SHAIK is the wife of Mr. Abdul Waheed SHAIK, a local businessman who runs IKRAM – Gea Engineers Sdn. Bhd., 56 JLN SS 1J/V Subang Jaya, a company that appears to be owned by Chinese Shareholders and is apparently involved in light engineering.

 

We are able to prove that Eusoff CHIN enjoyed a celebration dinner in his honour, hosted by Justice H.B. LOW and attended by 60 people, paid for by a local businessman’s wife. There was another celebration function attended by and paid for by the Judiciary in honour of Eusoff CHIN, some two weeks after this function.

 

A HIGH COURT JUDGE SOULD NOT BE HOSTING A FUNCTION FOR 60 PROMINENT PEOPLE IN HONOUR OF THE CHIEF JUSTICE; IT LEAVES THE JUDICIAL SYSTEM OPEN TO ALLEGATIONS IN RELATION TO PROMOTION, APPOINTMENTS AND IMPARTIALITY, as well as seeking the answer to why Mrs. SHAIK paid for the function.
